SECTION 39-6-12

   § 39-6-12  Filing of location of road– Citation. – Whenever any railroad company shall locate its road or any part thereof, it mayfile the report of the location with the clerk of the superior court for thecounty in which the located road is situated, and may, in writing, request theaction of the court thereon according to charter or general or special act, orthe provisions of § 39-6-13; and thereupon the clerk shall cause acitation to issue addressed to the parties named in the application, and madereturnable to the superior court in the county, which citation shall be servedupon the adverse parties in the same manner as process in a civil action, and,upon the return and entry thereof, the matter shall proceed in all respects asa civil action.
