SECTION 40.1-2-6

   § 40.1-2-6  Records and reports as toinstitution residents. – The department of mental health, retardation, and hospitals shall keep a recordshowing the name, residence, sex, age, nativity, occupation, condition, anddate of entrance or commitment of every patient or client in the severalinstitutions under the control of the department; the date, cause and terms ofdischarge, and the condition of those persons at the time of leaving; alltransfers from one institution to another; and if any patient or client dies,the date and cause of death. These and such other facts as the department mayfrom time to time require shall be furnished by the managing officer of eachinstitution to the director of the department of mental health, retardation,and hospitals within twenty-four (24) hours after the commitment, entrance,death, or discharge of any patient or client. In case of an accident, injury,or death under peculiar circumstances of a patient or client, the managingofficer shall make a special report within twenty-four (24) hours thereafter tothe director, giving the circumstances of the injury or death as fully aspossible. The record shall be accessible only to the director of thedepartment, the officers, agents, and employees thereof, except by permissionof the director or upon order of the governor or of a judge of a court ofrecord. Whenever it is required by law that a notice, order, or othercommunication be made to the department, it shall be a sufficient compliancewith the law if the notice, order, or other communication is made to thedirector of mental health, retardation, and hospitals.
