SECTION 40.1-22-16

   § 40.1-22-16  Discharge. – The director or the superintendent or official in charge of any facility, onhaving his or her reasons noted on the client's record, may discharge anyclient:

   (1) Who, in his or her judgment, is substantially improved.

   (2) Who, in his or her opinion, is not developmentallydisabled.

   (3) Who is not substantially improved but whose discharge, inhis or her judgment, will not be detrimental to the public welfare or injuriousto the client.
