SECTION 40.1-5.3-1

   § 40.1-5.3-1  Facility for incompetents andothers. – (a) The state director of mental health, retardation, and hospitals shallmaintain, at the state institution of Cranston, an appropriate facility for theconfinement of persons committed to his or her custody pursuant to this chapterand shall provide for the proper care, treatment, and restraint of all suchpersons. All persons now or hereafter committed, pursuant to the provisions of§§ 40.1-5.3-3, 40.1-5.3-4, 40.1-5.3-7, or the provisions of priorlaw, shall be removed or committed, as the case may be, to the facility.

   (b) The cost of care, maintenance, and treatment of personscommitted to the custody of the director of mental health, retardation, andhospitals, as provided in §§ 40.1-5.3-3 and 40.1-5.3-4, unlessotherwise provided for, shall be paid by the person, if he or she has anyestate, or by the person liable for his or her support, if such there be;otherwise, the director may maintain without charge or defray the expense ofcare and treatment of the poor or indigent persons incompetent to stand trialor acquitted on the grounds of insanity.
