SECTION 40-5.2-21

   § 40-5.2-21  Eligibility for medicalbenefits. – (a) Every member of any family/assistance unit eligible for cash assistanceunder this chapter shall be eligible for medical assistance through the RIteCare or RIte Share programs, as determined by the department, subject to theprovisions of subsection 40-8-1(d) and provided, further, that eligibility forsuch medical assistance, must qualify for federal financial participationpursuant to the provisions of Title XIX of the federal social security act, 42U.S.C. § 1396 et seq.

   (b) If a family becomes ineligible for cash assistancepayments under this chapter as a result of excess earnings from employment, thefamily/assistance unit shall continue to be eligible for medical assistancethrough the RIte Care or RIte Share program for a period of twelve (12) monthsor until employer paid family health care coverage begins, subject to theprovisions of subsection 40-8-1(d), whichever occurs first; and provided,further, that eligibility for such medical assistance, must qualify for federalfinancial participation pursuant to the provisions of title XIX of the federalsocial security Act, 42 U.S.C. § 1396 et seq.
