SECTION 40-6-4.1

   § 40-6-4.1  Ineligibility for aid orassistance commitment to training school or adult correctional institutions.– In the event that any child is committed to the training school or adultcorrectional institutions, and the child's parent(s) or qualifying relative arereceiving or are eligible for aid to families with dependent children (AFDC) asprovided pursuant to § 40-6-4, title IV-A of the Social Security Act, 42U.S.C. § 601 et seq., and the rules and regulations of the department, theeligibility of the parent(s) or qualifying relative for AFDC benefits for thechild who is placed in the training school shall be suspended during the timethe child is committed. The department of children, youth, and families ordepartment of corrections shall provide a list or computer compilation to thedepartment of human services, on a monthly basis, which shall identify thename, and if available, the date of birth and social security number of eachchild committed to the training school or adult correctional institutions, andthe name of the parent(s) or qualifying relative, of each child committed tothe training school or adult correctional institutions. Notwithstanding theprovisions of § 42-72-8, all information provided by this section shallremain confidential and shall be used only for the purposes of this section.Nothing in this section shall be construed to suspend the eligibility of theparent(s) or qualifying relative for AFDC benefits for any children notcommitted to the training school or adult correctional institutions.
