SECTION 40-8-13.2

   § 40-8-13.2  Prospective rate methodologyfor in-state hospital services. – As a condition of participation in the established prospective rate methodologyfor reimbursement of in-state hospital services, every hospital shall submityear-end settlement reports to the department within one year from the close ofa hospital's fiscal year. In the event that a participating hospital fails totimely submit a year-end settlement report as required, the department shallwithhold financial cycle payments due by any state agency with respect to thishospital by not more than ten percent (10%) until the report is received. Theprovisions of this section shall be repealed upon the promulgation ofamendments and new methodology pursuant to §§ 40-8-13.3 and40-8-13.4, but in any event no later than March 30, 2010.
