SECTION 42-12.1-3

   § 42-12.1-3  Transfer of functions from theformer department of social welfare. – There are hereby transferred to the director of the department of mentalhealth, retardation, and hospitals:

   (1) Those functions of the former department of socialwelfare which are administered through or with respect to the division ofcurative services, to include generally and specifically the hospitals, mentalinstitutions and other similar agencies (titles 14, 26 and 40); the division ofbusiness services to include generally and specifically all central management,financial and other services concerned with business and servicing operations,specifically excluding however the licensing of homes for the aged andconvalescent persons (title 40); and the mental health law (title 40);

   (2) All functions of the division of curative services,division of business services, and the mental health law formerly of thedepartment of social welfare and of all other officers, employees, agencies andadvisory councils, committees or commissions of the division of curativeservices, division of business services, and the mental health law;

   (3) So much of other functions or parts of functions of theformer director of the department of social welfare as is incidental to ornecessary for the performance of the functions transferred by subdivisions (1)and (2).
