SECTION 42-35-3.1

   § 42-35-3.1  Form for filing – Failureto properly file. – (a) All administrative rules and regulations are to be filed in duplicate (onecopy to be returned to the adopting agency, after proper stamping of datefiled), pursuant to a form prepared by the secretary of state; all agenciesmust adhere to the form when submitting rules and regulations to the secretaryof state pursuant to § 42-35-4.

   (b) The secretary of state is authorized to determine astandardized format for documents to be filed. Should an agency fail to use theadopted format, the secretary of state shall reject the rule and/or regulation.The secretary of state shall reject the improper rule and/or regulation byreturning the improperly drafted rule and/or regulation to the director of theagency which submitted the improper form within ten (10) days of receipt of theform.

   (c) The secretary of state may authorize the filing of rulesand regulations by or through electronic data or machine readable equipment insuch form and manner as may be determined by the secretary of state.
