SECTION 42-61-6

   § 42-61-6  Proceeds of sales –Segregated funds. – (a) All proceeds from the sale of lottery tickets or shares received by aperson in the capacity of a sales agent shall constitute a trust fund untilpaid into the state lottery fund.

   (b) The sales agent shall be personally liable for allproceeds; and failure to pay the lottery division moneys owed, upon demand,from the sales or misappropriation of the funds shall constitute embezzlementunder § 11-41-3.

   (c) The provisions of this section shall be enforced andprosecuted by the state police and the attorney general's office.
