SECTION 42-72-34

   § 42-72-34  Withholding services. –(a) It is the policy of the department not to require a parent to surrenderphysical possession or custody of his or her minor child or children basedsolely upon the department's provisions of services to the family. A surrendershall be determined by the family court or as otherwise provided by law.

   (b) In all cases the best interest of the minor child orchildren shall be paramount.
