SECTION 45-37.1-3

   § 45-37.1-3  Definitions. – As used in this chapter, the following words and terms have the followingmeanings, unless the context indicates another or different meaning or intent:

   (1) "Corporation" means the Rhode Island industrialfacilities corporation, created and established as a nonbusiness corporationunder and pursuant to chapter 6 of title 7, as amended, and constituted andestablished as a public body corporate and agency of the state by §45-37.1-4, or any board, body, commission, department, or officer succeeding tothe principal functions of the corporation or to whom the powers conferred uponthe corporation by this chapter are given by law.

   (2) "Industrial facility" means any project the corporationis authorized to finance.

   (3) "Industrial pollution" means any gaseous, liquid, orsolid waste substance, or combination thereof, resulting from any process ofindustry, manufacturing, trade, or business, or from the development,processing, or recovery of any natural resources which pollute the land, water,or air of the state.

   (4) "Municipality" means any city or town in the state.

   (5) "Project" means any land and any building or otherimprovement, and all real and personal properties, including, but not limitedto, machinery and equipment, or any interest in them, whether or not now inexistence or under construction, which are suitable for use for manufacturing,warehousing, or other industrial or commercial purposes, or suitable forpollution abatement or control, for the reconstruction, modernization, ormodification of existing industrial plants for the abatement or control ofindustrial pollution or suitable for solid waste disposal, or for anycombination of these purposes, including working capital, but does not includeraw materials, work in process, or stock in trade. "Project" also means anyrailroad rolling stock, including locomotives, cabooses, and vehicles for thetransportation of freight and shall also mean:

   (i) The construction and/or acquisition costs of marine craftand necessary machinery, equipment, and gear to be used primarily andcontinuously in the fishing industry by corporations, partnerships, orindividuals whose principal place of business and location are in the state ofRhode Island;

   (ii) The construction and/or acquisition costs and necessarymachinery and equipment of any marine craft for research or other usesconsidered to be an integral part of any land-based industrial concern, whichwould presently qualify for a loan guarantee under the Rhode Island industrialrecreational building authority;

   (iii) Acquisition costs of any existing building, machinery,and equipment for any project which would otherwise qualify for a loan underthe Rhode Island industrial recreational building authority;

   (iv) Any "recreational project", as that term is described inchapter 34 of title 42, relating to the loan guarantee program of the RhodeIsland industrial recreational building authority; or

   (v) Any other activity undertaken by the corporation.

   (6) "Solid waste" means any refuse matter, trash, or garbagefrom residences, manufacturing and industrial plants, hotels, apartments, orany other public or private building.

   (7) "State" means the state of Rhode Island and ProvidencePlantations.
