SECTION 45-49-2

   § 45-49-2  Authority of school committeesand municipal governments – Program requirements. – (a) All city and town school committees have the power to establish andoperate, contract for, and/or make provision for programs to provide before andafter school care and vacation day care for school age children in publicschool buildings. The provisions of title 16 are not applicable to any of theseday care committees.

   (b) All city and town school committees, city and towncouncils, and/or city and town managers, administrators, and mayors, as may beappropriate according to the form of government of each municipality, have thepower to establish and operate, contract for, and/or make provision forprograms to provide before and after school care and vacation day care forschool age children in locations other than public school buildings.

   (c) If the appropriate municipal authority establishes aprogram pursuant to this chapter, the appropriate municipal authority shalladopt rules and regulations governing school age child care programs, includingan application and contracting procedure by which qualified groups may apply tooperate these programs.

   (d) School age child care programs are completely separateand apart from the regular public school educational program. No school agechild care programs shall supplant or replace any part of the school curriculumprovided to all children as part of their free public education.

   (e) School age child care programs shall comply with allapplicable provisions of the general laws and with all applicable rules andregulations of the department of human services.
