   § 45-61.1-2  Storm drainage systeminspection. – (a) Storm drainage systems are herein defined as catch basins, conveyancestructures, and structural best management practices (BMPs) used for peak flowmitigation and runoff control/containment, water quality improvement and/orflood plain compensation.

   (b) In accordance with the findings of § 45-61-2 and thepurposes of this chapter, all storm drainage systems that are part of aregulated small municipal separate storm sewer system (small MS4), as definedin department of environmental management Rule 31(a)(5)(i) of the RIPDESRegulations, shall be inspected at least once per year, except those stormdrainage systems that are not designated by the owner or operator of aregulated small MS4 pursuant to subsection 45-61.1-3(b) as being prone tostreet flooding and/or contributing significantly to storm water managementproblems. Storm drainage systems prone to flooding or contributingsignificantly to storm water management problems shall be inspected at leastonce per year and maintained and cleaned as necessary in order to reduce therisks of flooding and ensure proper functioning of storm drain systems.
