SECTION 46-12-13

§ 46-12-13 Civil penalties. – Except as specified in §§ 46-12-26 and 46-12-27, any person who shallviolate the provisions of this chapter, or of any permit, rule, regulation, ororder issued pursuant thereto, shall be subject to a civil penalty of not morethan twenty-five thousand dollars ($25,000) for each day during which theviolation occurs. In an action for enforcement brought in the superior courtpursuant to this chapter or chapters 12.3, 12.4, or 12.5 of this title, thecourt also may order any person to pay to the director any and all costsincurred in the investigation, cleanup, and restoration of areas affected bypollutants in connection with any violation. Nothing herein contained shall beconstrued to limit the amount of monetary relief which the court can award inany action brought pursuant to any other provision of the general laws orpursuant to common law.
