§ 46-12-30.2 Definitions and guidelinesfor replacement and periodic inspection of tanks. – (a) All definitions and guidelines for replacement and periodic inspection oftanks shall be developed by the director of the department of environmentalmanagement in conjunction with the director's efforts to promulgate regulationsfor underground storage facilities used for petroleum products and hazardousmaterials, to be promulgated under the authority of this chapter and chapters17.1 and 35 of title 42.

(b) The regulations shall require that all federallyregulated underground storage tanks used for petroleum products and subject toregistration in this state shall be inspected at least once in each thirty-six(36) month period.

(c) Any funds remaining in the underground storage tankreplacement revolving loan program account after repeal of § 46-12-30.3shall be used in accordance with the provisions of subsections (a) and (b) ofthis section and any rules and regulations promulgated therein.
