§ 46-14-8 Penalties. – (a) Civil penalty. Any person who violates the provisions of thischapter, or any rule, regulation, or order issued pursuant thereto, shall besubject to a civil penalty of not more than five thousand dollars ($5,000) foreach day during which the violation occurs.
(b) Criminal penalty. (1) Any person whoshall be found guilty of violating, willfully or with criminal negligence, anyof the provisions of this chapter, or of any rule, or regulation issuedpursuant thereto, or an order of the director, shall be punished by a fine ofnot more than five thousand dollars ($5,000) or by imprisonment for not morethan thirty (30) days, or by both such fine and imprisonment, and every personshall be deemed guilty of a separate and distinct offense for each day duringwhich the violation shall be repeated or continued.
(2) Any person who knowingly makes any false statement,representation, or certification in any application, record, report, plan, orother document filed or required to be maintained under this chapter or by anyrule, regulation, or order issued under this chapter or who falsifies, tamperswith, or knowingly renders inaccurate any monitoring device or method requiredto be maintained under this chapter, or by any permit, rule, regulation, ororder issued under this chapter, shall, upon conviction, be punished by a fineof not more than five thousand dollars ($5,000) for each instance of violationor by imprisonment for not more than thirty (30) days, or by both such fine andimprisonment.
