SECTION 46-25-25.3

   § 46-25-25.3  Criminal penalties. –(a) Any person who shall be found guilty of violating, willfully or withcriminal negligence, any of the provisions of §§ 46-25-25 –46-25-25.3 or of any permit, rule, or regulation issued pursuant thereto, or anorder of the commission, shall be punished by a fine of not more thantwenty-five thousand dollars ($25,000) or by imprisonment for not more than oneyear, or by both a fine or imprisonment; and every person shall be deemedguilty of a separate and distinct offense for each day during which theviolation shall be repeated or continued. Further, the person shall be liablefor all damages directly related to the violation, including additional costsof handling and treating any prohibited wastes, and shall reimburse thecommission for actual enforcement costs incurred by the commission, includingreasonable attorney's fees and administrative costs.

   (b) No person shall knowingly make any false statement,representation, or certification in any application, record, report, plan, orother document filed or required to be maintained under § 46-25-25 or46-25-25.1 or by any permit, rule, regulation, or order issued under thosesections, or shall falsify, tamper with, or knowingly render inaccurate anymonitoring device or method required to be maintained under those sections orby any permit, rule, regulation, or order issued under those sections.

   (c) No person shall discharge into any outlet within thedistrict any sewage waste or other pollutants without a permit, except wheresuitable treatment has been provided in accordance with this chapter or therules and regulations of the commission.

   (d) No person shall construct or maintain any privy, privyvault, septic tank, cesspool, or other facility intended or used for thedisposal of sewage waste or other pollutants within the district, except asotherwise provided by law or the rules and regulations of the commission.

   (e) No person shall maliciously, willfully, or negligentlybreach, damage, destroy, uncover, deface, or tamper with any structure,appurtenance, or equipment or dump garbage, refuse, or other material on landor right-of-way which is a part of the facilities of the project.

   (f) No person shall uncover, make any connection with, oropening into, use, alter, or disturb any interceptor or appurtenance thereof,without first obtaining a written permit from the commission.

   (g) No person shall discharge or cause to be discharged anyunpolluted waters such as stormwater, groundwater, roof runoff, subsurfacedrainage, uncontaminated cooling water, or unpolluted industrial process watersto any facilities of the project other than those discharges as are connectedto an existing (prior to May 1, 1982) combined sewer in those areas in which acombined sewer is the only available means for disposal of unpolluted waters.
