SECTION 46-5-7

   § 46-5-7  Late filing of petition for jurytrial. – The court may, in its discretion, permit the filing of the petition subsequentto one year from the filing of the description, plat, and statement, unless thepetitioner therein has had actual notice of the taking of the land in which thepetitioner claims an interest in season to have filed his or her petitionwithin the year, and unless the state has then paid some other person for theestate or interest or become liable to pay for the estate or interest under ajudgment rendered against the state under the provisions of this chapter.
