SECTION 5-19.1-17

   § 5-19.1-17  Central database –Operation. – (a) Pharmacies operated by a person pursuant to this chapter may refillprescriptions which have been previously dispensed by an affiliated pharmacy;provided, that prior to dispensing a refill, the pharmacy refilling theprescription verifies the appropriateness of the refill through a centralizeddatabase.

   (b) Clinic pharmacies operated by a health maintenanceorganization licensed under chapter 41 of title 27 and this chapter may refillprescriptions which have been previously dispensed by another healthmaintenance organization clinic pharmacy; provided, that prior to dispensing arefill, the pharmacy refilling the prescription verifies the appropriateness ofthe refill through a centralized database of that health maintenanceorganization.

   (c) Disclosure of prescription information to any otherperson(s) other than agents of properly licensed pharmacies pursuant tosubsection (a) or (b) of this section is prohibited. Disclosure of prescriptioninformation is permitted only to those directly involved in patient careconsistent with chapter 37.3 of this title, Health Care Communications andInformation.

   (d) The disclosure of prescription information to researchersmay only be authorized in accordance with Federal Policy for the Protection ofHuman Subjects.
