SECTION 5-19.1-19

   § 5-19.1-19  Pharmacists –Substitution of drugs. – Pharmacists when dispensing a prescription shall, unless requested otherwise bythe individual presenting the prescription in writing, substitute drugscontaining all the same active chemical ingredients of the same strength,quantity, and dosage form as the drug requested by the prescriber from approvedprescription drug products in accordance with the provisions of §21-31-16, unless ordered by the prescribing physician to dispense as brand namenecessary on the prescription form, or if the prescriber gives oral directionto that effect to the dispensing pharmacist. The requirements of this sectionshall not apply to an order to dispense a drug for immediate administration toa licensed hospital, nursing facility or hospice facility in-patient. Thepharmacist will make a product selection from approved prescription drugproducts and shall pass the savings on to the ultimate consumer. When a drugproduct selection is made, the pharmacist shall indicate the product dispensedon the written prescription or on the oral prescription, which has been reducedto writing, or product information may be maintained on a computerized systemif information is readily retrievable.
