SECTION 5-45-2

   § 5-45-2  Functions of the department ofhealth. – It is the function of the department of health to:

   (1) Develop, impose, and enforce standards, which must be metby individuals in order to receive a license as a nursing home administrator.These standards shall be designed to insure that nursing home administratorswill be individuals who are of good character and are suitable, and who, bytraining or experience in the field of institutional administration, shall bequalified to serve as nursing home administrators;

   (2) Establish and carry out procedures designed to insurethat individuals licensed as nursing home administrators will, during anyperiod that they serve as nursing home administrators, comply with therequirements of those standards;

   (3) Receive, investigate, and take appropriate action withrespect to any charge or complaint filed with the department to the effect thatany individual licensed as a nursing home administrator has failed to complywith the requirements of those standards;

   (4) Conduct a continuing study and investigation of nursinghomes and administrators of nursing homes within the state, with a view toimproving the standards imposed for the licensing of those administrators, andof procedures and methods for enforcing those standards with respect tolicensed nursing home administrators.
