SECTION 5-63.2-6

   § 5-63.2-6  General powers of board. –The board is authorized to recommend to the director of the department ofhealth for his or her approval the adoption, and from time to time, therevision of the rules and regulations not inconsistent with law that may benecessary to enable it to carry into effect the provisions of this chapter. Theboard shall recommend for licensure at least twice a year. It shall determinethe tests which applicants for licensure take. The division of professionalregulation shall adopt policies to be followed in the examination, licensureand renewal of licenses of qualified applicants. The board shall conducthearings upon charges calling for the discipline of a licensed clinical mentalhealth counselor or licensed marriage and family therapist or for revocation ofa license. The administrator of professional regulation has the power to issuesubpoenas and compel the attendance of witnesses and administer oaths topersons giving testimony at hearings. The board or the director of thedepartment of health shall cause the prosecution of all persons violating thischapter and has the power to incur the necessary expenses for the prosecution.The board shall make provisions for continuing educational requirements forlicensure. The board shall keep a record of all its proceedings.
