SECTION 5-70-22

   § 5-70-22  Authority of director to assesspenalty. – (a) The director may assess an administrative penalty on any person, firm orcorporation for any violation of the provisions of this chapter, after noticeand hearing, before and upon the recommendation of the board of examination oftelecommunication system contractors, technicians and installers in the amountof not more than five hundred dollars ($500) for the first offense and not lessthan five hundred dollars ($500) nor more than one thousand dollars ($1000) foreach subsequent offense; provided, that the director of labor and training mayrevoke any telecommunication license for a failure to pay any fine recommendedby the board and approved by the director of labor and training within thirty(30) days.

   (b) A copy of the order shall be immediately served upon thelicensee personally or by registered or certified mail. The order of the boardshall be final unless the licensee so charged or complainant shall withintwenty (20) days after receipt of the order file with the director of labor andtraining an appeal. The appeal will be determined by the director or his or herdesignee. The director may accept or reject, in whole or in part, therecommended order of the board. The order of the director shall be final,subject to review by the courts under the Administrative Procedures Act,chapter 35 of title 42, and a copy of the order shall be immediately servedupon the person, firm or corporation assessed.
