SECTION 8-2-30

   § 8-2-30  Petition for change of venue.– Applications for the removal of any civil action, suit, or proceeding, asprovided in § 8-2-29, shall be by petition setting forth the cause orreasons therefor, which petition shall be filed in the office of the clerk ofthe superior court for the county where the action, suit, or proceeding ispending, and a copy thereof served on the adverse party, or on his or herattorney of record, within ten (10) days after the filing of the petition; andno such petition in any civil cause shall be heard until the expiration of five(5) days after the service of the copy, unless by agreement of the parties.
