SECTION 9-1-3.1

   § 9-1-3.1  Liability of parents andunemancipated minors for torts to each other. – A parent may be held liable for injuries caused to his or her unemancipatedminor child by the parent's negligent acts or omissions. In all cases in whichthe injured minor is living, prior to the commencement of any civil actionhereunder, a petition shall be brought in the superior court in the county inwhich the injured minor resides for the appointment of a guardian ad litem topursue the action on behalf of the minor. The guardian ad litem shall not be amember of the minor's family. Once appointed, the guardian ad litem shall beempowered to make all decisions on behalf of the minor relating to the cause ofaction against the parent. If the minor is deceased, the civil action may becommenced by his or her executor or administrator.
