TITLE 25MENTAL AND PHYSICAL ILLNESS OR DISABILITYCHAPTER 25-01GENERAL PROVISIONS25-01-01.Definitions.In this title, unless the context or subject matter otherwiserequires:1."Defective delinquent" means an incompetent mentally deficient person over<br>eighteen years of age who has been found, in accordance with the procedures<br>established in chapter 25-04, to have demonstrated a pattern of aggravated<br>antisocial behavior such as to present a probable peril to the life, person, or property<br>of others, or who has given substantial evidence of continuing propensity for such<br>behavior.2."Licensed physician" means an individual licensed under the laws of this state to<br>practice medicine and also means a medical officer of the government of the United<br>States while in this state in the performance of the physician's official duties.3."Mentally deficient person" means any person, minor or adult other than a mentally<br>ill person, who is so mentally defective as to be incapable of managing that person's<br>affairs and to require supervision, control, and care for that person's own or the<br>public welfare.4."Mentally ill individual" means an individual having a psychiatric or other disease<br>which substantially impairs the individual's mental health.5."North Dakota vision services - school for the blind" means the North Dakota vision<br>services - school for the blind as maintained under section 25-06-01.6."School for the deaf" means the school for the deaf of North Dakota.7."State hospital" means the state hospital for the mentally ill.8."Superintendent" means the superintendent ofthestatehospital,ofthedevelopmental center at westwood park, Grafton, of North Dakota vision services -<br>school for the blind, or of the school for the deaf, as the case may be.9."Supervising officer" means the executive director of the department of human<br>services or the superintendent of public instruction, as the case may be.25-01-01.1. State council on developmental disabilities. There must be maintained inthe department of human services a state council on developmental disabilities consisting of one<br>representative of each of the following departments, divisions, institutions, and organizations<br>designated by the head of such agency or organization:1.Office of superintendent of public instruction.2.North Dakota department of human services.3.State department of health.4.Developmental center at westwood park, Grafton.5.Job service North Dakota.Page No. 1The council shall, at a minimum, include representation that conforms to federal lawrequirements regarding state councils on developmental disabilities. All members of the council<br>must be appointed by the governor. The council shall select its own officers who shall serve for a<br>term of two years commencing on October first of each year. Meetings must be held at least<br>twice a year or at the call of the chairman or upon notice in writing signed by not less than three<br>members of the council. A simple majority of the council constitutes a quorum and may act upon<br>any matter coming before the council. Members of the council are entitled to reimbursement in<br>the same manner and at the same rate provided by law for other state officials.The council shall assist in the development of the state plan for developmentaldisabilities, monitor and evaluate the implementation of such state plan, and review and<br>comment on all state plans in the state which relate to programs affecting persons with<br>developmental disabilities. The council may take any action reasonably necessary to secure and<br>administer any money made available to state councils on developmental disabilities through the<br>Developmentally Disabled and Bill of Rights Act [Pub. L. 95-602; 92 Stat. 2955; 42 U.S.C. 6000<br>et seq.]. The council, if approved by the governor, shall appoint a full-time director who shall<br>assist the council. The director must be classified under the state personnel merit system. The<br>council shall also perform studies and surveys of the needs of developmentally disabled persons<br>in North Dakota and shall facilitate coordination of the activities of all state departments,<br>divisions, agencies, and institutions having responsibilities in the field of developmental<br>disabilities.25-01-02.Transfer of patients between institutions.The supervising officer maytransfer patients of the state hospital or developmental center at westwood park, Grafton<br>between such institutions whenever the superintendent of any such institution shall recommend<br>such transfer and the supervising department is satisfied, upon investigation, that such transfer is<br>advisable. If any patient, so transferred, is maintained at the expense of the county from which<br>the patient was committed, the cost of the patient's maintenance in the institution to which the<br>patient is transferred must be charged to such county and must be collected therefrom upon<br>notice to the county auditor of such county by the supervising officer.25-01-02.1. context or subject matter otherwiserequires:1.\u0026quot;Defective delinquent\u0026quot; means an incompetent mentally deficient person over\u003cbr\u003eeighteen years of age who has been found, in accordance with the procedures\u003cbr\u003eestablished in chapter 25-04, to have demonstrated a pattern of aggravated\u003cbr\u003eantisocial behavior such as to present a probable peril to the life, person, or property\u003cbr\u003eof others, or who has given substantial evidence of continuing propensity for such\u003cbr\u003ebehavior.2.\u0026quot;Licensed physician\u0026quot; means an individual licensed under the laws of this state to\u003cbr\u003epractice medicine and also means a medical officer of the government of the United\u003cbr\u003eStates while in this state in the performance of the physician's official duties.3.\u0026quot;Mentally deficient person\u0026quot; means any person, minor or adult other than a mentally\u003cbr\u003eill person, who is so mentally defective as to be incapable of managing that person's\u003cbr\u003eaffairs and to require supervision, control, and care for that person's own or the\u003cbr\u003epublic welfare.4.\u0026quot;Mentally ill individual\u0026quot; means an individual having a psychiatric or other disease\u003cbr\u003ewhich substantially impairs the individual's mental health.5.\u0026quot;North Dakota vision services - school for the blind\u0026quot; means the North Dakota vision\u003cbr\u003eservices - school for the blind as maintained under section 25-06-01.6.\u0026quot;School for the deaf\u0026quot; means the school for the deaf of North Dakota.7.\u0026quot;State hospital\u0026quot; means the state hospital for the mentally ill.8.\u0026quot;Superintendent\u0026quot; means the superintendent ofthestatehospital,ofthedevelopmental center at westwood park, Grafton, of North Dakota vision services -\u003cbr\u003eschool for the blind, or of the school for the deaf, as the case may be.9.\u0026quot;Supervising officer\u0026quot; means the executive director of the department of human\u003cbr\u003eservices or the superintendent of public instruction, as the case may be.25-01-01.1. State council on developmental disabilities. There must be maintained inthe department of human services a state council on developmental disabilities consisting of one\u003cbr\u003erepresentative of each of the following departments, divisions, institutions, and organizations\u003cbr\u003edesignated by the head of such agency or organization:1.Office of superintendent of public instruction.2.North Dakota department of human services.3.State department of health.4.Developmental center at westwood park, Grafton.5.Job service North Dakota.Page No. 1The council shall, at a minimum, include representation that conforms to federal lawrequirements regarding state councils on developmental disabilities. All members of the council\u003cbr\u003emust be appointed by the governor. The council shall select its own officers who shall serve for a\u003cbr\u003eterm of two years commencing on October first of each year. Meetings must be held at least\u003cbr\u003etwice a year or at the call of the chairman or upon notice in writing signed by not less than three\u003cbr\u003emembers of the council. A simple majority of the council constitutes a quorum and may act upon\u003cbr\u003eany matter coming before the council. Members of the council are entitled to reimbursement in\u003cbr\u003ethe same manner and at the same rate provided by law for other state officials.The council shall assist in the development of the state plan for developmentaldisabilities, monitor and evaluate the implementation of such state plan, and review and\u003cbr\u003ecomment on all state plans in the state which relate to programs affecting persons with\u003cbr\u003edevelopmental disabilities. The council may take any action reasonably necessary to secure and\u003cbr\u003eadminister any money made available to state councils on developmental disabilities through the\u003cbr\u003eDevelopmentally Disabled and Bill of Rights Act [Pub. L. 95-602; 92 Stat. 2955; 42 U.S.C. 6000\u003cbr\u003eet seq.]. The council, if approved by the governor, shall appoint a full-time director who shall\u003cbr\u003eassist the council. The director must be classified under the state personnel merit system. The\u003cbr\u003ecouncil shall also perform studies and surveys of the needs of developmentally disabled persons\u003cbr\u003ein North Dakota and shall facilitate coordination of the activities of all state departments,\u003cbr\u003edivisions, agencies, and institutions having responsibilities in the field of developmental\u003cbr\u003edisabilities.25-01-02.Transfer of patients between institutions.The supervising officer maytransfer patients of the state hospital or developmental center at westwood park, Grafton\u003cbr\u003ebetween such institutions whenever the superintendent of any such institution shall recommend\u003cbr\u003esuch transfer and the supervising department is satisfied, upon investigation, that such transfer is\u003cbr\u003eadvisable. If any patient, so transferred, is maintained at the expense of the county from which\u003cbr\u003ethe patient was committed, the cost of the patient's maintenance in the institution to which the\u003cbr\u003epatient is transferred must be charged to such county and must be collected therefrom upon\u003cbr\u003enotice to the county auditor of such county by the supervising officer.25-01-02.1.
