§  441-a.  Discharge  of  other  inmates. Subject to the provisions of  article seven  hundred  thirty  of  the  criminal  procedure  law  where  applicable, the superintendent of an institution for the retarded in the  department  of  correction,  with  the  approval  of  the commisioner of  correction, may discharge any inmate thereof, committed thereto  without  sentence  or  under  an  indefinite  sentence,  if  it be found that his  further confinement therein is unsuitable.
