§  612. United States prisoners. 1. A sheriff must receive into his or  her jail and keep a prisoner, committed to the same, by virtue of  civil  process  issued  by a court of record, instituted under the authority of  the United States, until he or she is discharged by the  due  course  of  the laws of the United States, in the same manner as if he was committed  by  virtue  of  a  mandate in a civil action, issued from a court of the  state. A sheriff or jailer, to whose jail a civil prisoner is committed,  as prescribed herein, is answerable for his or her safe keeping  in  the  courts of the United States, according to the laws thereof.    2. The commissioner may enter into an agreement to provide for custody  by  the  department  of  persons  who are being detained by virtue of an  order issued by a court of the United States. An  agreement  made  under  this  section  shall  require  the  United  States  to  pay  the cost of  treatment, maintenance and custody furnished by the department.
