§ 27-2615. Department responsibilities.    1.  The  department  is authorized to promulgate rules and regulations  necessary to implement and administer this  title.  At  a  minimum,  the  department  shall  promulgate  rules  and  regulations on: standards for  reuse; electronic waste acceptance credits;  waivers  of  the  recycling  surcharge;  and  acceptable alternative methods for the determination of  state sales data.    2. The department shall (a) maintain a list of manufacturers  who  are  registered  pursuant  to  section  27-2605 of this title, (b) maintain a  list of each such manufacturer's brands, and (c) post such lists on  the  department's website.    3.  The  department  may  waive  the  recycling surcharge payable by a  manufacturer under this title when the manufacturer demonstrates  in  an  application  to  the  department  it  was unable to accept the weight of  electronic waste required by section 27-2603 of this title  despite  the  manufacturer's  best  efforts.  The  application  shall be made with the  annual report required by section 27-2617 of this title. The application  shall include such information as  the  department  requires.  A  waiver  provided  pursuant  to this subdivision shall not relieve a manufacturer  from the obligation to comply with the  provisions  of  this  title  not  specifically addressed in such waiver.
