§ 89-mmm.  Armored  car  carrier  advisory  board.  1. There is hereby  created within the department the "Armored Car Carrier Advisory  Board",  hereinafter referred to as the "Board". Such board shall consist of five  members  representative  of  the  armored  car  carrier  industry. Three  members shall be appointed  by  the  governor,  one  of  whom  shall  be  representative   of   a   domestic   carrier,   one  of  whom  shall  be  representative of  a  foreign  carrier  and  one  of  whom  shall  be  a  representative of the New York Armored Car Association, Inc.    One  member shall be appointed by the governor upon the recommendation  of the temporary president of the senate. One member shall be  appointed  by  the governor upon the recommendation of the speaker of the assembly.  All members of the board appointed by the governor shall serve for a two  year term. Each such member shall holdover and continue to  serve  until  his  or her successor is appointed as prescribed herein. Any such member  may be reappointed to the board.    2. The secretary shall designate a chairman of the board and the board  shall meet at least once a year.  Staff services, including recording of  board proceedings, shall be performed by personnel of the department.    3. The board shall advise the  department  and  the  division  in  the  administration  and  enforcement  of this article and article eight-C of  this chapter and shall  recommend  to  the  secretary  and  commissioner  regulations  necessary  to effectuate the provisions of such articles of  this chapter.    4. The members of the board shall serve  without  compensation  except  that  each  of  them  shall be allowed the necessary and actual expenses  which he or she shall incur in the performance  of  his  or  her  duties  hereunder not to exceed two thousand five hundred dollars per year.    5.  The  members  of the board for the purposes of section eighteen of  the public officers law, shall be considered officers or employees of  a  public entity.
