§ 256. Duties of clerk of court of appeals.  1. The clerk of the court  of appeals must keep his office at the city of Albany.    2.  Before  entering upon the duties of his office, he must subscribe,  and file the constitutional oath of office.    3. He must, within ten days after the first day of January, and  after  the  first  day  of  July,  in  each  year, render to the comptroller an  accurate account, under oath, of  all  fees  received  by  him  for  his  official services, since the last account was rendered; and must pay the  same into the treasury of the state.    4. The judges of the court of appeals or a majority of them shall have  the  power  to  make, from time to time, rules fixing and regulating the  fees of the clerk of the court of appeals and all his duties in relation  to such fees.
