§ 45.10 Adult home and residence for adults special oversight authority.    (a)  The commission shall have the following authority with respect to  adult homes or residences for adults, as defined by section two  of  the  social  services  law, where at least twenty-five percent or twenty-five  of the residents, whichever is less, are persons who have  at  any  time  received  or are receiving services from a mental hygiene provider which  is licensed, operated or funded by the office of mental  health  or  the  office of mental retardation and developmental disabilities.    (1)  investigation  of  complaints  regarding  the  quality  of  care,  including mental hygiene services, provided to such residents who had at  any time received or are receiving services  from  such  mental  hygiene  provider;    (2)  examination  of the programmatic and financial operations of such  adult homes or residences for adults; and    (3) examination  of  the  programmatic  and  financial  operations  of  providers  of  mental  hygiene  services  to  residents of such homes or  residences. Such financial  audit  shall  only  be  conducted  upon  the  approval of the chair of the commission.    (b)  Upon  completion  of  any review or investigation conducted under  this section, the commission may make findings concerning  such  matters  referred  to its attention and make a report and recommendations thereon  to the operator of such home and any appropriate commissioner of a state  agency. Such commissioner and operator shall make a  written  report  of  actions  taken  regarding  the  recommendations of the commission within  ninety days of receipt  of  such  report.  The  commission  may  require  further periodic reports as it deems appropriate.
