§  244.  Lighting  cars on elevated railroads in cities of over twelve  hundred thousand inhabitants. Every corporation  operating  an  elevated  railroad in any city of over twelve hundred thousand inhabitants in this  state,  computed  according  to  the  state  enumeration had in eighteen  hundred and ninety-two, shall equip all cars used for the transportation  of passengers with the most approved system of lighting  passenger  cars  now in use upon railroads, either by electricity or gas of not less than  eighteen  candle  power,  and  every such corporation is prohibited from  using kerosene or coal oils as a means of lighting any of its  passenger  cars.  Any  violation of the provisions of this section shall render any  such corporation liable to pay a fine or penalty of  fifty  dollars  for  each  and  every  day,  for  each  and  every passenger car run over its  railroad which is not equipped and lighted as provided herein; and  such  fine  may  be  recovered  by  any passenger on such railroad who may sue  therefor; and any violation of the provisions of  this  section  on  the  part of any such railroad corporation shall also be a misdemeanor.
