<br><br>13A.125 Restriction of subsequent amendment to pending regulation or regulation <br>with amendment already filed. <br>Prior to the effective date of a new administrative regulation, or an amended <br>administrative regulation that has been filed with the Legislative Research Commission, <br>an administrative body shall not file subsequent amendments to that administrative <br>regulation unless: <br>(1) Failure to do so would result in a loss of accreditation, or federal or state funds, or <br>the imposition of another state or federal penalty; or <br>(2) A court decision, or a federal or state mandate requires immediate implementation <br>of the amendment; or <br>(3) Conditions warrant the filing of an emergency administrative regulation; or <br>(4) The amendments are made: <br>(a) After a public hearing or public comment period as provided by KRS <br>13A.280; or <br>(b) At a subcommittee meeting during which the administrative regulation is <br>reviewed as provided by KRS 13A.290. <br>Effective: June 24, 2003 <br>History: Amended 2003 Ky.
