<br><br> <br>Page 1 of 1 <br>39A.130 Appeal from award of Board of Claims. <br>(1) The owner of property seized, taken, or condemned may appeal from the award of <br>the Board of Claims to the Circuit Court of the county of the owner's residence. The <br>Rules of Civil Procedure shall, so far as applicable, govern the procedure on appeal. <br>A trial de novo shall not be allowed unless the record on appeal is not sufficient to <br>determine the matter from the record, but if the action is tried, it shall be tried <br>according to the practice prescribed for the trial of jury cases. <br>(2) An appeal from the judgment of Circuit Court may be taken to the Court of <br>Appeals. <br>Effective: July 15, 1998 <br>History: Created 1998 Ky.
