<br><br>67.240 Certification of results of election -- Appointment of commissions to lay off <br>justices' districts and select choice of names and county seats. <br>(1) The result of the election in each county shall be certified by the county election <br>commissioners to the county judge/executive in each county. If a majority of the <br>voters of each county, voting on the proposition, approve the consolidation, the <br>county judge/executive of each county shall, within thirty (30) days after the <br>election, appoint a commission to be composed of three (3) voters of the county for <br>the purpose of dividing the area of the new county into districts for the election of <br>members of the fiscal court for the new county. The said commissions representing <br>the two (2) counties shall meet together within fifteen (15) days after their <br>appointment and proceed to divide the area of the new county into three (3) <br>districts, each to be as nearly equal in area and population as possible. The <br>commissions also shall select not less than two (2) and not more than three (3) <br>names for the new county, and shall select not less than two (2) nor more than three <br>(3) sites for the county seat of the new county. The report of the commissions, <br>which shall act jointly, shall be filed with the county judge/executive of each county <br>not less than ninety (90) days after the appointment of the commissions. <br>(2) If, at the expiration of ninety (90) days after the six (6) commissioners have been <br>appointed as provided for herein, a majority of said commissioners have failed to <br>agree upon the selection of three (3) names for the proposed county or three (3) <br>places for the county seat to be submitted to the voters of the county as provided for <br>in KRS 67.260, the Governor of the Commonwealth of Kentucky shall appoint a <br>seventh person to act as chairman of said board of commissioners and said <br>chairman shall not have a vote on any question except in case of a tie vote. The <br>report of the commissions, when a chairman is appointed, shall be filed with the <br>county judge/executive of each county not less than thirty (30) days after <br>appointment of the chairman. <br>Effective: June 17, 1978 <br>History: Amended 1978 Ky.
