<br><br>71.130 Procedure for testing inmate for infectious diseases to be established -- <br>Confidentiality of results. <br>(1) Each county and each municipal detention facility shall have a written procedure <br>developed, in consultation with the facility medical provider, establishing <br>conditions under which an inmate will be tested for infectious disease. The <br>procedure shall be consistent with guidelines of the Centers for Disease Control and <br>recommendations of the Correctional Medical Authority. The person receiving the <br>test results may divulge the test results to the jailer or chief correctional officer. <br>However, all other provisions of the Kentucky Sexually Transmitted Disease <br>Control Confidentiality Act in KRS 214.400 to 214.420 shall remain in effect. <br>(2) Serologic blood test results obtained pursuant to subsection (1) of this section shall <br>be confidential except they may be shared with employees or officers of the jailer or <br>chief correctional officer who are responsible for the custody and care of the <br>affected inmate and have a need to know the information. No person to whom the <br>results of a test have been disclosed under this section may disclose the test results <br>to another person not authorized under this section. <br>(3) The results of any serologic blood test on an inmate shall become a part of that <br>inmate's permanent medical file. Upon transfer of the inmate to any other <br>correctional facility, the file shall be transferred in an envelope marked confidential. <br>Effective: July 13, 1990 <br>History: Created 1990 Ky.
