<br><br>90.180 Appointments to positions in classified service -- Probationary <br>appointments. <br>(1) All appointments to positions subject to the provisions of KRS 90.110 to 90.230 <br>shall be made solely on the basis of merit and fitness, to be determined by <br>competitive examinations, except in the case of emergency appointments which <br>may be made only in accordance with the definition given in KRS 90.110; provided <br>that all original appointments, except emergency appointments as defined in KRS <br>90.110, shall be probationary appointments for a period of not less than six (6), nor <br>more than twelve (12), months, after which probationary period regular <br>appointments shall be given to all probationary employees who are deemed to be <br>satisfactory by the respective appointing authority. <br>(2) Except in the case of emergency appointments as defined in KRS 90.110, all <br>appointments to positions subject to the provisions of KRS 90.110 to 90.230 shall <br>be made by appointing authorities only from an eligible list certified by the <br>personnel director as qualified and eligible for appointment from an appropriate <br>eligible list as defined in KRS 90.110; provided however, that all employees <br>holding positions subject to the provisions of KRS 90.110 to 90.230 on the effective <br>date thereof who were holding positions in classified service under provision of <br>previous acts, shall be considered as having satisfied hereunder all of the <br>qualifications for obtaining and holding such appointments as they then had, and <br>further provided that all employees holding positions subject to the provisions of <br>KRS 90.110 to 90.230, on the effective date thereof, and who were not holding <br>positions in classified service under provisions of previous acts, shall be considered <br>as having satisfied hereunder all of the qualifications for obtaining and holding <br>original appointments under KRS 90.110 to 90.230, and shall be considered as <br>having been given probationary appointments, as defined in KRS 90.110, as of the <br>effective date thereof. <br>History: Created 1942 Ky.
